1.1. About us and these terms and conditions
Aoeyewear.fr is managed by Serus Distribution, French company registered in France with the commerce tribunal of Arras. If you have any comments or suggestions, we would be pleased to receive them by the contact form.

1.2 These Terms and Conditions govern the supply by us of any Product ordered by you on aoeyewear.fr. By ordering a Product, you agree to be legally bound by these Terms and Conditions.

2. Customer’s account

2.1 For you to be able to Order Products on aoeyewear.fr or you must have a registered Account. We reserve the right to delete duplicate Accounts and deny any Customers who do not comply with our Terms and Conditions the right to use their Account. We may also edit or delete these Accounts as part of our virtual householder’s rights.

2.2 When you register an Account, you will be asked to state some personal details. If you do not state this information, we will not register an Account and you will not be able to Order Products on aoeyewear.fr. We will notify you by e-mail when your registration is completed.

2.3 We are not obliged to accept all registration requests or all Orders, even when placed by registered Customers nor are we obliged to keep a consistent range of products or keep any Products available permanently. This clause does not affect Orders that have already been placed.

2.4 By registering on or placing an Order through aoeyewear.fr

– you are at least 18 years old

2.5 You are responsible for assuring that all information you enter as part of the registration process is correct, complete and up to date. Your personal data will be stored and processed by aoeyewear.fr in the manner stated in aoeyewear.fr privacy policy. You will receive a confirmation email after registering online.

2.6 You are responsible for keeping your personal log-in information secure and confidential.

2.7 You are solely responsible for all information you enter into any accessible areas (e.g. blogs). No entries may encroach upon third party rights. We are not obliged to save or publish your entries e.g. Product reviews.

3. Effect

3.1 These terms and conditions shall apply to all orders and contracts made or to be made by us for the sale and supply of products. When you submit an order to us, give any delivery instruction or accept delivery of the products, this shall in any event constitute your unqualified acceptance of these terms and conditions. Nothing in these terms and conditions affects your statutory rights (including the right to insist that goods you buy from businesses must correspond with their description, be fit for their purpose and be of satisfactory quality).

3.2 These terms and conditions shall prevail over any separate terms put forward by you. Any conditions that you submit, propose or stipulate in whatever form and at whatever time, whether in writing, by email or orally, are expressly waived and excluded.

3.3 No other terms or changes to the terms and conditions shall be binding unless agreed in writing signed by us.

4. Payment

We offer payment by Paypal, Credit card, Apple Pay, Google Pay and Bank transfer.

5. Cancellation by us

5.1 We may cancel a contract if the product is not available for any reason. If this is the case, we will notify you and return any payment that you have made.

5.2 We will refund any money received from you, using the same method originally used by you to pay for the product.

6. Faulty Product

6.1 We warrant that:

1. a) the product will be delivered undamaged in the quantities ordered

2. b) the product will conform with every pictures listed on the article’s description

7.SHIPMENT & DELIVERY

Products will be delivered to the address provided by the Customer when placing the order.

– Every products on aoeyewear.fr is stock in France.

Unless otherwise stated in the order confirmation email, orders are generally dispatched within 24 to 72 business hours following payment confirmation.

Delivery times are provided for information purposes only and may vary depending on the destination, the shipping method selected, and circumstances beyond our control. aoeyewear.fr shall not be held liable for delays or failure to deliver resulting from external events such as strikes, transportation disruptions, severe weather conditions, administrative restrictions, or any other force majeure event.

Colissimo with signature (home delivery)
24 to 48 business hours (mainland France) / 3 to 6 business days (Europe & UK)

UPS Standard
24 to 48 business hours (mainland France) / 2 to 5 business days (Europe & UK)

In the event of a delivery delay exceeding fourteen (14) business days beyond the announced delivery date, except in cases of force majeure, the Customer shall be entitled to request cancellation of the order and receive a refund of all sums paid, in accordance with applicable laws.

The Customer is required to inspect the delivered products upon receipt.

Any issue concerning the products (damage, missing item compared to the order confirmation, damaged or opened package, broken or defective item, etc.) or any dispute regarding the delivery must be reported to our Customer Service Department within three (3) days of the delivery date.

8.EXCHANGE & RETURNS

The customer must submit their request via the contact form.

The customer has a statutory period of 14 days from the date of receipt of the goods to exercise their right of withdrawal, without having to provide any reason or pay any penalties.

The terms and conditions for exercising this right of withdrawal are set out in the “Exchange and Return Conditions” section below.

Return shipping costs are covered for customers in Metropolitan France and European Union countries.

The customer will receive a full refund of all amounts paid as soon as possible and, in any event, no later than 14 days from the date on which they exercised their right of withdrawal.

Exchange and Return Conditions for Refunds :

Returned item(s) must be new, unused and in their original packaging, which must be in perfect condition.

The product must not have been worn, meaning that its use must not exceed the time reasonably necessary to try it on.

The product must be returned to us in its original packaging, complete and in perfect condition, together with all accompanying items (unopened and unused microfiber cleaning cloth, warranty documents), which must not be damaged, altered or soiled.

Returned products must be properly packaged to prevent any damage during transportation.

Any exchange or return must first be requested by email or by sending a message via the contact form

The customer may submit only one online return or exchange request per order placed on www.aoeyewear.fr

The customer must retain the proof of postage provided by the postal service. In the event that the return parcel is lost, no exchange, refund or further processing of the order can be carried out without this proof of postage.

The customer has 14 days from the date of the return request to send the goods back. No return will be accepted after this period.

If you withdraw from this contract, we will refund all payments received from you, including delivery costs (except for any additional costs resulting from your choice, where applicable, of a delivery method other than the least expensive standard delivery method offered by us).

Upon receipt of the parcel, aoeyewear.fr will inspect the condition of the returned goods. No return will be accepted if the returned items have been visibly used or damaged by the customer and such use or damage makes the items unsuitable for resale.

If the return is refused by aoeyewear.fr, the items will be sent back to the customer at the expense of aoeyewear.fr, without the customer being entitled to claim any compensation or refund, without prejudice to any statutory warranty rights relating to the goods sold.

In the event of an exchange, if the returned items have been visibly used or damaged by the customer and such use or damage makes them unsuitable for resale, aoeyewear.fr reserves the right to take any appropriate action to recover the corresponding amount from the customer.

We reserve the right to refuse a return if the product is damaged, if one or more items are missing, or for hygiene reasons.

9. WARRANTY

American Optical offers a lifetime warranty on all AO sunglasses*. We believe things should be built to last. When you purchase AO sunglasses, we commit to standing by that product for a lifetime.

AO warranties protect against manufacturer’s defects but does not cover normal wear and tear, including scratches on the lenses, or damage caused by abuse or mishandling.

This warranty applies only to American Optical sunglasses purchased from authorized AO dealers and is valid for the original purchaser only.

*Available for products manufactured and purchased since September 1, 2020

10. INTERNATIONAL SHIPMENT

Regarding international shipments, please make sure to check your local laws, rules and regulations in regards to all customs or brokerage fees, duties, taxes and restrictions imposed on goods imported into the country of destination, as all fees mentioned above are the responsibility of the recipient and not aoeyewear.fr. All costs incurred on a refused delivery because of high customs or brokerage fees, duties, taxes or restrictions imposed by the country of destination are the responsibility of the customer.

11. EUROPEAN SHIPMENT

As American Optical France is located in France we are shipping directly from France to our European customers. This means our European customers pay no customs duties or additional VAT.
